These Terms of Service ("Terms") constitute a legally binding agreement between you (and the business entity you represent) and Chongqing MSDD Engine Co., Ltd. ("MSDD Engine", "we", "us", or "our"), located at Gold Peak Center, No. 2 Saidi Road, Chongqing, China. These Terms govern your access to and use of https://msddengine.com, our online part-number search and technical guides, our request-for-quotation (RFQ) channels, and any connected software applications or OAuth integrations published by MSDD Engine.

2. Independent Supplier & OEM Trademark Disclaimer

• All third-party manufacturer names, brand marks (including CAT, Caterpillar, Perkins, and FG Wilson), engine model designations, and OEM part numbers displayed on this website are the property of their respective owners and are used strictly for product identification, cross-referencing, and technical fitment verification.
• Prior to balance payment or dispatch, MSDD Engine provides real-time warehouse photographs and videos of actual products, original packaging, and serial/part markings for buyer confirmation.

3. Quotations, Orders & Commercial Terms

• Invitation to Inquire: Product listings, technical parameters, and availability indicators on https://msddengine.com are provided for technical reference and constitute an invitation to request a B2B quotation, not a binding retail offer.
• Formal Proforma Invoice / Contract: Pricing, currency, Incoterms (e.g., EXW, FCA, FOB, CIF, DAP), lead time, packing standards (such as ISPM 15 fumigated wooden crating), and payment schedules become binding only when confirmed in a written Proforma Invoice (PI) or Commercial Sales Contract issued by Chongqing MSDD Engine Co., Ltd.
• Quotation Validity: Unless otherwise stated on the Proforma Invoice, commercial quotations remain valid for 7 to 15 calendar days due to active global warehouse turnover and freight rate fluctuations.

4. Technical Fitment Verification & Serial Numbers

Industrial diesel engines frequently undergo engineering supersessions and serial-number breaks. To ensure 100% part compatibility:

• Buyers are strongly encouraged to provide the complete Engine Serial Number (S/N), arrangement number, or a clear photograph of the engine nameplate when submitting an inquiry.
• Where MSDD Engine engineers verify fitment in writing against your provided Engine Serial Number via CAT SIS or Perkins SPI, we guarantee the supplied part number matches the factory catalog specification for that serial number.
• Where a buyer orders strictly by part number without providing an Engine Serial Number for verification, the buyer assumes responsibility for confirming that the requested part number matches their specific equipment configuration.

5. Warranty & Limitation of Liability

• Standard B2B Warranty: Unless otherwise specified in the Commercial Sales Contract, complete engine assemblies, generator sets, and core long-block components carry a 12-month or 1,000-operating-hour warranty (whichever occurs first) against manufacturing defects from the date of dispatch, subject to installation and maintenance in accordance with OEM operation manuals.
• Consumables & Wear Parts: Normal maintenance consumables (such as filter elements, gaskets, and seals) are warranted to be free from defects upon delivery and pre-installation inspection.
• Limitation of Liability: To the maximum extent permitted by applicable law, MSDD Engine's aggregate liability arising out of any product supply or website service shall not exceed the purchase price paid for the specific goods giving rise to the claim. In no event shall MSDD Engine be liable for indirect, incidental, or consequential damages, including downtime, loss of production, or lost profits.

6. Digital Services, OAuth Integrations & Acceptable Use

When using our website, live search index, inquiry endpoints, or any authorized OAuth/API application operated by MSDD Engine, you agree not to:

• Submit fraudulent inquiries, automated spam, or malicious file attachments to /api/inquiry.php (our endpoint enforces automated per-IP rate limiting and MIME verification);
• Attempt to probe, scan, scrape at disruptive rates, or bypass security controls on https://msddengine.com or its content management infrastructure;
• Misuse any authenticated Google OAuth or API integration in violation of applicable law or Google's Terms of Service.

7. Intellectual Property & Data Privacy

All original website layouts, engineering selection guides, warehouse photography, and compiled catalog structures on https://msddengine.com are the intellectual property of Chongqing MSDD Engine Co., Ltd. Your submission of personal and business data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
